What is a decree nisi?
A Decree Nisi is a crucial document within the divorce process. It sets out the details of the divorce and is issued once the court is satisfied that the grounds for divorce have been proven. This document outlines important information such as:
- Who is entitled to what (e.g., assets, property)
- Custody arrangements for any children
- The reasons for the divorce
The Decree Nisi does not finalize the divorce but is a key step towards it. The final document, the Decree Absolute, is typically issued 6 weeks later, unless new evidence arises that challenges the grounds for the divorce.
Can a Decree Nisi be Used as Proof of Divorce?
While the Decree Nisi signifies that the court is satisfied with the grounds for divorce, it is not accepted as proof of divorce for purposes such as remarriage. This is because, technically, the divorce can still be reversed until the Decree Absolute is granted. In practice, however, the Decree Nisi should indicate that the divorce will be finalized in 6 weeks, unless any challenges are made.
